TO THE FULLEST EXTENT PERMITTED BY APPLICABLE UNITED STATES LAW, INCLUDING APPLICABLE STATE LAW, SEASONS PIZZA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS (COLLECTIVELY, "SEASONS PIZZA PARTIES") SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
• LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL.
• DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE THE SITE OR SERVICES.
• DAMAGES ARISING FROM ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.
• DAMAGES ARISING FROM THE CONDUCT OF ANY THIRD PARTY ON OR THROUGH THE SITE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE SEASONS PIZZA PARTIES FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO SEASONS PIZZA IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Seasons Pizza and the Seasons Pizza Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorney's fees and court costs) arising from or relating to:

• Your violation of any third-party rights, including without limitation any intellectual property or privacy rights.

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding individual arbitration administered by a recognized arbitration body such as JAMS or the American Arbitration Association (AAA), under their applicable rules. The arbitration shall take place in the United States, at a location mutually agreed upon by the parties or as determined by the arbitrator. The language of the arbitration shall be English.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorney's fees in connection with arbitration, unless otherwise awarded by the arbitrator in accordance with applicable law.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Such a request shall not be deemed a waiver of the obligation to arbitrate.

15. Term and Termination

These Terms shall remain in full force and effect for as long as you use the Site or our services. We reserve the right, in our sole discretion, to:
